Federal Holidays

The 2013 Federal Holidays are set out on the U.S. Office of Personnel Management (OPM) Operating Status & Schedules page. These days are established by 5 U.S.C. 6103. The designation of a day as a “Federal Holiday” only establishes rights for federal employees.

Executive Order:

No. 11582 (Feb 11, 1971), 36 F.R. 2957, (Feb. 13, 1971): Observance of holidays by Government agencies.

Case law:

Ganulin v. United States, 71 F. Supp 2d 824 (1999, SD Ohio), aff’d 238 F.3d 420, cert. denied 532 U.S. 973 (2001).

Note: The law does not impose any requirements on private or state employers. The United States Department of Labor FAQ:

Question: How are vacation pay, sick pay, and holiday pay computed and when are they due?

Answer: The Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations, sick leave or holidays (federal or otherwise). These benefits are a matter of agreement between an employer and an employee (or the employee’s representative).”

This is not the case in many countries, according to data from Mercer. Looking at the table in Employee Holiday Entitlements Around the World the workers entitled to the most holidays are those in Columbia with 18.
